Countdown To Precarious Eviction In Spain

No Protection In Law - Despite Elaborate Laws On Gender Based Violence In Spain.

Two English Women. Two different endings. Two similar situations.
They were not married. They live in the countryside of Spain, and both women depend financially on their partners.
Both women had no name in the property deeds, trusting their partners to do the right thing.
Both women were named as sole beneficiaries and protected in the event of the death of their partners.
Both partners go off to live with another woman, leaving their former partners still living in the Spanish homes that would be their retirement homes.
Both partners offer a financial settlement.
Both partners move the goalposts.

One woman eventually receives a financial settlement when two Spanish Solicitors battle it out and finalise negotiations. The payment was made via a banker's draft, so it could not be cancelled. She spent over three years living in fear of being forced out of the property with no settlement.

Conflicting Legal Advice
In my situation, I was advised by a Spanish Solicitor to file a gender violence complaint with the Police.
I was also told not to move out of the property. At the time, I asked the solicitor to write to the other solicitor, hoping to negotiate. The solicitor repeated his advice, saying, "Did you not hear what he said? You can not negotiate with him."

When I went through the Courts, it did not help me. There were two hearings, and then the case was dismissed. The original solicitor read through the judgement and told me that the court had only heard a case of one minor verbal abuse and not a longer case of bad behaviour. His advice was to appeal. The College of Solicitors appointed a free lawyer, I asked him about an appeal and I was informed his job was done I needed to find a new lawyer.

Other conflicting legal advice: The free lawyer at the CAVI charity told me not to file any further complaints as I would make him angry. He was already angry. The lawyer also said I should negotiate. I had already tried to negotiate. This was part of the reason why the first lawyer told me to make the gender violence complaint.

No other woman should have to go through the situation I experienced because I followed legal advice.

None of the financial offers he made were honoured. Even if a signed agreement was not honoured, he was in control; he had the money and the power. I was left in grief and trauma, fear and uncertainty as soon as he threatened that he could throw me out onto the streets.

The meeting we had on September 15, 2020, was recorded with his permission. We were meant to discuss the financial proposals, but he was angry after seeing a GoFundPage I had written and shared privately. I was fearful that he would be angry and abusive, so I asked if we could record our meeting. It didn't make any difference; he was still verbally aggressive, intimidating, and threatening towards me.
