The Free Speech Coalition has published guidance on new UK laws that criminalise the distribution and possession of certain consensual adult sexual content, including material involving choking, roleplay and age play.

The rules take effect on 6 November.

FSC notes that while more detailed regulatory guidance is still expected from bodies such as Ofcom, the legislation is already on the books and carries the possibility of significant fines as well as criminal charges.

Executive Director Alison Boden said the organisation had attempted to parse the provisions and the risks they create for members, while stressing that FSC cannot give legal advice. “These are draconian bans with serious penalties for creators, platforms and consumers, and FSC members should take the law seriously,” she said.

Boden added that the laws were pushed through under the claim of targeting violent and dangerous content, yet they apply to legal, consensual sexual activity between adults. The Coalition is urging members with UK exposure to consult a specialist lawyer and review their content for potential liability.
